MARTINSBURG, W.Va. - For the second time in less than a year, a Martinsburg attorney has been charged with writing a felony bad check.

Keith Lewis Wheaton, 34, of 177 Stone Point, surrendered himself at magistrate court Wednesday at 10:30 a.m., Martinsburg City Police said.

Wheaton was released on a $5,000 personal recognizance bond set by a state magistrate. A spokesman at the Eastern Regional Jail said Wheaton was not in custody there Wednesday night.

The most recent allegation is that Wheaton issued a $23,150.86 check to a couple in regards to a civil lawsuit settlement in which Wheaton was the couple's attorney, police said.

That check was returned from a local bank stamped nonsufficient funds on Jan. 30, police said.

Last year, Wheaton was arrested on March 9, police said. In that case, Magistrate Joan Bragg issued an arrest warrant alleging Wheaton issued a worthless $10,000 check to a woman in October 2000, police said.

The outcome of that case wasn't known Wednesday.

A domestic dispute Tuesday night erupted in violence when a beer bottle was broken over a man's head, Maryland State Police alleged.

Cammie Hope Zello, 40, of 13 E. Oak Ridge Drive, was charged with first-and second-degree assault, said Sgt. Steve McCarty.

She posted a $10,000 bond Wednesday and was released from custody, officials at the Washington County Detention Center said.

The 7:09 p.m. incident occurred at Zello's home which she shares with Harvey Dailey Edmond Nelson, McCarty said.

A check at Washington County Hospital Wednesday revealed no record that anyone named Harvey Nelson had been seen at the hospital.
