Md. man not guilty of rape, jury decides

CHAMBERSBURG, Pa. - A jury deliberated three hours Thursday before finding a Maryland man not guilty of rape and other charges, according to Franklin County Court of Common Pleas records.

Irvin L. Varner, 26, of Fort Ritchie, Md., was also acquitted of statutory sexual assault and corruption of a minor, according to court records. The two-day trial was held before Judge Carol Van Horn.

According to the affidavit of probable cause filed by the Washington Township (Pa.) Police Department, Varner was charged in February after police interviewed a 14-year-old girl who was a reported runaway. The girl told police she was raped by a man in her home on the night of Dec. 23-24, the affidavit said.

Assistant District Attorney Angela Krom said last week that Varner was staying at the girl's home when the incident occurred.
