Shepherdstown, W.Va., man sentenced for cocaine



WHEELING, W.Va. - A Shepherdstown, W.Va., man was sentenced Monday in U.S. District Court in Wheeling by Chief Judge Frederick P. Stamp for aiding and abetting in the distribution of crack cocaine, said U.S. Attorney Melvin W. Kahle Jr.

Victor Randolph Lewis Hamilton Jr. was sentenced to three years and one month, to be followed by three years of supervised release.

Hamilton pleaded guilty on May 31 to one count of aiding and abetting in the distribution of 1.37 grams of crack cocaine on Dec. 9, 1999, in Shepherdstown.

Hamilton was remanded to the custody of the U.S. marshal following the sentencing.

Two other people entered guilty pleas Monday before Stamp:

HEIGHT="6" ALT="* "> Elizabeth Miller, 30, of 3600 Orchard St., Weirton, W.Va., pleaded guilty to one count of distribution of cocaine on Jan. 20 in Weirton. Miller is free on bond pending sentencing, Kahle said. The possible maximum penalty for distribution of cocaine is 20 years in federal prison and a $1 million fine.

HEIGHT="6" ALT="* "> Johnny Mack Brown, 29, of 209 Avenue D, Weirton. pleaded guilty to one count of distribution of cocaine on Oct. 21, 1999, in Weirton. Brown is in custody pending sentencing. Brown faces the same maximum penalty as Miller.

HEIGHT="6" ALT="* "> Jerry Dague, 30, of 1010 Summerlea Lane, Washington, Pa., pleaded guilty to one count of possession with intent to distribute cocaine on March 8 in Weirton. Dague is free on bond pending sentencing. Dague faces the same maximum penalty as Brown.

In other federal cases, a 28-year-old Martinsburg man was sentenced last week in U.S. District Court in Martinsburg, W.Va., to 57 months in federal prison for distribution of heroin, Kahle said.

Christopher E. Livengood, of 601 Warm Springs Ave., Martinsburg, W.Va., was sentenced by U.S. District Judge W. Craig Broadwater to the 57 months on Monday. The 57-month incarceration will be followed by three years supervised release.

Livengood pleaded guilty May 17 to one count of distribution of heroin on Aug. 18, 1998, in Martinsburg.

After the sentencing, Livengood was remanded to the custody of the U.S. Marshal.
