Man gets probation in sex case involving stepdaughter

A 43-year-old Hagerstown man who admitted fondling his stepdaughter on at least two occasions last year was given probation before judgment Monday in Washington County Circuit Court.

The victim, now 16, has run away from home and was unavailable to testify, according to court records.

In exchange for the plea to one count of fourth-degree sex offense, additional charges of child abuse and second-degree assault against the man were dropped, court records said.

The man's name is being withheld to protect the identity of the victim.

According to court records, the victim told Maryland State Police her stepfather first touched her breasts in May 1999. A few days later, her stepfather invited her to come up to the attic where he again touched her breasts and also her genital area, she alleged in court records.

Judge Kennedy Boone placed the man on probation for 18 months and fined him $145.

The man is continuing counseling, according to court records.
