Man to serve five years in sex case

Getting a 12-year-old girl pregnant after forcing her to have sex earned a a Pennsylvania man twice her age a five-year prison sentence Wednesday in Washington County Circuit Court.

David Steven Pogue, 25, of Waynesboro, Pa., pleaded guilty to a third-degree sex offense.

According to Assistant Washington County State's Attorney Susan Lochbaum, the victim told the Department of Social Services a year ago that Pogue was the father of the child she had in 1997 when she was 12 years old.

Pogue visited the home of a relative of his wife and encountered the girl on a number of occasions when no one else was around, Lochbaum said.

It was on those occasions that the victim told authorities she had to continuously fight him off and she finally "gave up."


The baby was put up for adoption shortly after it was born, Lochbaum said.

Initially contacted about the victim's accusations, Pogue denied any contact with the girl.

In June, blood tests were done and the results showed that the chances were 99.86 percent that Pogue was the father of the child, Lochbaum said.

Pogue then admitted the sexual contact but insisted it was consensual.

"I know all about this case ... I had to put the victim in foster care and terminate her parental rights," Boone said.

Pogue's wife, who has begun divorce proceedings, was in court Wednesday with her 4-year-old son. And it was revealed that Pogue's fiancee just gave birth to another of his children.

"The victim's letter asked me to give him three years in prison because he 'hurt me really bad,'" Boone said, quoting the girl's own words.

Instead, Boone sentenced Pogue to the maximum 10-year prison term and suspended five of those years.
