Va. man charged in alcohol-related accident death

MARTINSBURG, W.Va. - A Winchester, Va., man was indicted Wednesday on a charge that he was driving while intoxicated last year and caused a crash that killed another man.

The one-count indictment against Benjamin Travis Brown, 22, was handed up by a Berkeley County grand jury.

Douglas Allen Hartley II, 21, died in the February 1999 crash on Interstate 81 at the Exit 12 entrance ramp near the Martinsburg Mall.

Hartley was a passenger in a 1994 International tractor-trailer driven by Brad A. Henise, 29, of York, Pa.

Brown was driving on to the interstate when his pickup began sliding into the southbound lane, according to West Virginia State Police. Henise tried to avoid Brown's pickup truck, police said, but the vehicles collided, damaging the rig's passenger side.

Police said they believe Hartley died instantly in the 1:55 a.m. crash.

The indictment alleges Brown was under the influence of alcohol at the time, was traveling too fast for road conditions and failed to control his pickup.
