Father gets 5 years in sex abuse case

January 25, 2000

Washington County Circuit Judge Kennedy Boone Tuesday sentenced a 39-year-old Hagerstown man to serve five years in prison for sexually assaulting his deaf daughter on several occasions in 1999.

The man, whose name is being withheld to protect the identity of his 13-year-old daughter, pleaded guilty to a third-degree sex offense, Boone said in a telephone interview.

The sentence was the maximum 10-year sentence for third-degree sex offense, but Boone said he suspended five years.

Boone said he ordered that the man be placed on supervised probation for 18 months after his release from prison and that he register as a sex offender.

Remaining charges including child abuse, a second-degree sex offense, and second-degree assault were dropped in exchange for the plea, according to court records.

In October, a representative of the Washington County Department of Social Services asked police for help in interviewing the victim, a student at the Maryland School for the Deaf in Frederick, Md., court records said.

At that interview, the teen alleged that her father had been sexually assaulting her from August until Oct. 14, when she first told someone of the abuse, court records said.
