Rezoning application amended

July 28, 1999

The Hagerstown City Council voted 5-0 Tuesday to amend a rezoning application for Mount Aetna Road property, which is the subject of a controversial rezoning and annexation request to the city.

The amendment would change the underlying zoning designation for the property from R2 to R1. Both are residential zoning designations, but the R1 designation is more restrictive.

The change would become a factor only if the land is annexed and development plans for the property, which are being considered separately, are dropped.

If the annexation and development plan is approved, the current landowner, Triad Properties, would sell the land to a development partnership headed by Hagerstown developer and builder Wes Churchey under the plan presented to the city.

Then 230 housing units in brick quads, triples and duplexes would be built on the 36.7 acres, which is surrounded by the Brightwood Acres, Londontowne and Fairway Meadows subdivisions.

The property is part of the old Fox Deceived plantation and currently has an agricultural zoning.

A public hearing on the zoning change will probably be Aug. 24, City Clerk Gann Breichner said.

It was not known when a final vote on the development plan and annexation may be taken.
