Neighbors to decide who has right of way over lane

FUNKSTOWN - A dispute between neighbors over use of a grass lane near Funkstown Park won't be settled by town officials, the parties were told Monday night.

Noel Brady brought the dispute, involving the lane he uses to access the back of his property on Beaver Creek Road, to the mayor and Town Council.

Robert E. Kuczynski, attorney for the town, said that while the town has a right of way to use the land it's not the same as it being a public street.

"It's not your province to stick your finger in that. That's my legal opinion," Kuczynski told the mayor and council.

Brady was told it was up to him and neighbors Dan and Evamarie Koenig, of 302 E. Maple St., to work out right-of-way issues.
