Man charged with sexual assault on 5-year-old girl

June 07, 1999

MARTINSBURG, W.Va. - A Martinsburg man was charged with felony first-degree sexual assault based on allegations he had sex with a 5-year-old girl, according to court records.

Roger T. Johnson, 23, was arraigned June 5 in Berkeley County Magistrate Court and was being held on $15,000 bond in the Eastern Regional Jail near Martinsburg, according to court records.

A woman called Martinsburg City Police on June 4 and told investigators her son was at a friend's home and saw a man standing over a naked girl who was lying on a bed, according to court records.

The boy told police the man had his underwear down around his ankles and told the boy not to tell anyone what he had seen, according to court records.

Police said the boy's mother talked with the 5-year-old girl and said the girl told her the man had sex with her, according to court records.

Police said evidence taken in the case has been sent to the West Virginia State Police Crime Lab in Charleston, W.Va.

Conviction on first-degree sexual assault carries a sentence of up to 35 years in prison and a $10,000 fine.
