W.Va. man charged after vehicle death

MARTINSBURG, W.Va. - A Berkeley Springs, W.Va., man has been charged with negligent homicide in a Nov. 5 crash on W.Va. 45 that claimed the life of a Martinsburg man.

Timothy W. Kesner, 21, was arraigned on the charge in Berkeley County Magistrate Court on Monday.

Police alleged he was traveling at a "reckless and unsafe speed" when his 1993 full-sized Ford pickup truck slid through an intersection east of Foxcroft Avenue and struck a 1989 Dodge Aries in the side at about 2:30 p.m. on Nov. 5.

The driver of the Dodge, Terry L. Shepherd, 45, was taken to Martinsburg City Hospital, where he died.

Police said Kesner suffered a slight cut in the accident and the two passengers in his truck were uninjured.

Investigators from the Martinsburg barracks of the West Virginia State Police alleged Kesner was driving too fast and failed to stop for a red light at the W.Va. 45 intersection in front of Lowe's, according to court records.


Kesner was released on $5,000 bond.

A conviction on the misdemeanor charge carries a maximum penalty of a $1,000 fine and up to a year in jail.
