Girl won't be charged in baby's death

MARTINSBURG, W.Va. - No charges will be filed in the case of a 15-year-old Falling Waters, W.Va., girl who threw her stillborn daughter in the garbage after a secret birth on Sept. 19, according to West Virginia State Police.

Berkeley County Prosecutor Pamela Games-Neely found no charges applicable to the situation, Sgt. J.A. Humphrey said Thursday.

The baby was found in a garbage bag by the girl's mother, who until then didn't know her daughter had given birth or was even pregnant, police said.

The girl's mother took the baby and her daughter to Washington County Hospital in Hagerstown, where the baby was pronounced dead, according to police.

An autopsy performed in Baltimore showed the baby was born dead, police said.
