Smithsburg man faces child-pornography charges

A 27-year-old Smithsburg man charged with child pornography and abuse offenses was released Friday after posting $50,000 bond and spending a night in jail.

Jay Leroy Overcash, of 22038 Jefferson Blvd., has been charged with possession of child pornography, filming a child in a sex act, child abuse and contributing to the condition of a child.

The victim is 6 years old, according to court records.

A Washington County Sheriff's Department investigation revealed that on July 9, a man videotaped himself in the nude and that the child was with him at the time.

Although those tapes were cut and placed in the trash, they were recovered and repaired by forensic chemist Jeff Kercheval at the Western Maryland Regional Crime Laboratory.


At first, the videotape showed the child clothed but then she removed her clothing, court records said. The child was then asked to touch herself and she did, court records said.

The man then asked her to perform sex acts on him and she refused, court records said.

During most of the homemade videotape, an X-rated tape was being played on another VCR with both the man and the child watching it, court records said.

When the child was questioned by Investigator Kenny Barnhart, she said she and the man would go down into the basement, "get naked" and make a movie.

The man allegedly told the child not to say anything or they would get into trouble, court records said.

If convicted of all four charges, Overcash could face 29 years in prison and $30,000 in fines.
